Refund and Cancellation Policy

1. Scope and Definitions

This Refund and Cancellation Policy (“Policy”) governs the cancellation of subscriptions to and refunds for the RingRealtor platform and all related services (the “Service”) provided by KAPION d.o.o., a company registered in Slovenia under registration number 1683438000, with its registered office at Kocljeva ulica 16, 9000 Murska Sobota, Slovenia, VAT ID SI32880227 (“Company,” “we,” “us,” or “our”).

This Policy supplements our Terms of Service and applies to all self-service subscription plans. Enterprise customers with individually negotiated agreements should refer to their specific contract terms. In the event of a conflict between this Policy and your individual agreement, your individual agreement prevails.

The following terms have specific meanings in this Policy:

  • Subscription means your active, paid access to the Service under a selected plan
  • Billing Cycle means the recurring monthly period during which your subscription fees are charged
  • Cancellation means the termination of your subscription and recurring billing
  • Refund means a return of fees previously paid to your original payment method
  • Service Credit means a credit applied to your account for use against future charges

2. Subscription and Billing Terms

RingRealtor subscriptions are billed on a monthly basis. Your billing cycle begins on the date of your initial subscription and recurs on the same date each month.

  • Monthly subscription fee: charged in advance at the beginning of each billing cycle for the upcoming month of service
  • Per-minute usage charges: AI Agent call time is billed at the applicable per-minute rate ($0.90 per minute) and charged monthly in arrears based on actual usage during the preceding billing cycle
  • Payment methods: payments are processed through our third-party payment processor. We accept the payment methods made available through our checkout process.

All prices are quoted in United States Dollars (USD) and are exclusive of applicable taxes unless otherwise stated.

3. Auto-Renewal

Your subscription renews automatically at the end of each monthly billing cycle at the then-current subscription rate. By subscribing to the Service, you expressly authorize us and our payment processor to charge your designated payment method on a recurring monthly basis until you cancel.

You may prevent renewal by canceling your subscription before the next billing date. If you cancel, your subscription will not renew and you will not be charged for subsequent billing cycles.

If the price of your subscription plan changes, we will notify you at least thirty (30) days before the new price takes effect. The new pricing will apply starting with the first billing cycle following the notice period. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.

4. Free Trial Terms

We may offer free trial periods at our discretion. If you enroll in a free trial, the following terms apply:

  • The trial duration, features included, and any limitations will be disclosed at the time of enrollment
  • If we collect payment information during the trial, your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel before the trial expires
  • We will send you a reminder notification at least three (3) days before your trial expires, informing you of the upcoming charge, the amount, and how to cancel
  • You may cancel at any time during the trial period without being charged
  • Free trials are limited to one per customer. We reserve the right to charge the standard subscription fee if we determine that a trial is being used in a manner inconsistent with the trial offer terms

5. How to Cancel

You may cancel your subscription at any time using any of the following methods:

  • Online (recommended): log in to your account, navigate to your billing or subscription settings, and select the option to cancel your subscription. The cancellation process requires no more than two steps from your account settings page.
  • Email: send a cancellation request to rok@kapion.eu from the email address associated with your account. We will process your request and confirm cancellation within two (2) business days.

We are committed to providing a straightforward cancellation process. You will not be required to navigate through obstructive steps designed to delay or prevent cancellation.

When cancellation takes effect: your cancellation takes effect at the end of your current billing cycle. You will retain full access to the Service until that date. No further charges will be made after cancellation, except for any outstanding per-minute usage charges from the current or preceding billing cycle.

Cancellation confirmation: upon cancellation, you will receive a confirmation email to the address associated with your account. The confirmation will include the effective date of cancellation, any remaining charges, information about your data, and instructions for reactivating your account if you change your mind.

6. Refund Eligibility

We offer refunds under the following circumstances:

  • Billing errors: if you were charged incorrectly due to a billing system error, duplicate charge, or technical malfunction, you are entitled to a full refund of the erroneous amount
  • Unauthorized charges: if a charge was made without your authorization, contact us immediately. We will investigate and issue a full refund for any verified unauthorized charge.
  • Service failure: if the Service is materially unavailable or non-functional for an extended period due to causes within our control and we are unable to remedy the issue within a reasonable timeframe, you may be eligible for a pro-rata refund for the affected period
  • EU/EEA consumers — 14-day withdrawal right: if you are a consumer residing in the European Union or European Economic Area, you have the right to withdraw from your subscription within fourteen (14) days of the initial purchase without giving any reason. See Section 10 for full details.

Non-refundable charges: the following charges are generally non-refundable:

  • Subscription fees for billing periods that have already commenced, except as described above or as required by applicable law
  • Per-minute usage charges for AI Agent call time that has already been consumed
  • Fees for partial months of service when you cancel mid-cycle (you retain access until the end of the billing period)

Nothing in this Policy limits your rights under applicable consumer protection law. If mandatory consumer protection legislation in your jurisdiction provides for greater refund rights, those rights apply.

7. Refund Process and Timelines

To request a refund, contact us at rok@kapion.eu with your account email address and a description of the reason for your request. We will review your request and respond within ten (10) business days.

Refund calculation:where a pro-rata refund applies, it is calculated as follows: Refund = (Unused Days ÷ Total Days in Billing Period) × Monthly Subscription Fee. Per-minute usage charges already incurred are not included in the refund calculation.

Refund method: all refunds are issued to the original payment method used for the transaction. We are unable to issue refunds to alternative payment methods.

Processing time: once a refund is approved, it will be processed within five (5) to ten (10) business days. The actual time for the refund to appear in your account depends on your payment provider and may take additional time beyond our processing window.

8. Service Credits

In the event of Service downtime or degraded performance that falls below our operational standards, we may issue service credits at our discretion. Service credits are:

  • Applied to your account as a credit against future subscription charges
  • Not redeemable for cash or transferable to another account
  • Valid for twelve (12) months from the date of issuance
  • Forfeited upon cancellation of your subscription if not yet applied to a billing cycle

Service credits represent the sole and exclusive remedy for Service availability issues, unless otherwise required by applicable law.

9. Plan Changes and Downgrades

You may change your subscription plan at any time through your account settings. Plan changes are handled as follows:

  • Upgrades: if you upgrade to a higher-priced plan, the price difference is prorated for the remainder of your current billing cycle and charged immediately. Your new plan features become available immediately upon upgrade.
  • Downgrades: if you downgrade to a lower-priced plan, the change takes effect at the beginning of your next billing cycle. You retain access to your current plan features until then. If the lower plan has reduced storage, user limits, or feature access, you are responsible for adjusting your usage before the downgrade takes effect.

Following a plan downgrade, we will retain your data for thirty (30) days to allow you to export or adjust your usage. After this period, data exceeding your new plan’s limits may be deleted. If your new plan has lower storage or feature limits, certain features or data may become inaccessible until you upgrade or adjust your usage.

10. EU/EEA Consumer Withdrawal Right

If you are a consumer residing in the European Union or European Economic Area, you have the right to withdraw from your subscription within fourteen (14) days of the date of purchase without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU).

How to exercise your withdrawal right: to withdraw, send us an unequivocal statement of your decision to withdraw (for example, by email to rok@kapion.eu). You may use the following model withdrawal statement, but it is not obligatory:

“I hereby give notice that I withdraw from my contract for the provision of the RingRealtor service. Ordered on [date] / received on [date]. Name of consumer. Address of consumer. Date and signature (only if sent on paper).”

Effect of withdrawal: if you withdraw within the 14-day period, we will reimburse all payments received from you without undue delay, and in any event no later than fourteen (14) days from the day on which we are informed of your decision to withdraw. The refund will be issued using the same payment method you used for the initial transaction, unless you expressly agree otherwise. No fees will be charged for the refund.

Service used during the withdrawal period: if you requested that the Service begin during the withdrawal period, you shall pay us an amount proportional to the service provided up to the time you communicated your withdrawal, in comparison with the full coverage of the contract.

11. Data Handling After Cancellation

Upon cancellation of your subscription, your data is handled as follows:

  • Retention period: we retain your Customer Data for thirty (30) days after the effective date of cancellation. During this period, you may request an export of your data.
  • Data export: you may request an export of your data before the end of the retention period by contacting us at rok@kapion.eu. We will provide your data in CSV or JSON format within ten (10) business days. Post-cancellation data export requests may be subject to a reasonable administrative fee at our then-current rates.
  • Deletion: after the thirty-day retention period, we will delete your Customer Data from our active systems. Residual copies may persist in encrypted backups for up to ninety (90) additional days, after which they are purged.
  • Legal retention: we may retain certain data beyond the standard retention period where required by law, including billing and transaction records for tax and accounting purposes (retained for seven years) and data subject to active legal holds
  • Account reactivation: if you reactivate your subscription within the thirty-day retention period, we will use commercially reasonable efforts to restore your data. After the retention period, reactivation creates a new account without prior data.

12. Billing Disputes and Chargebacks

If you believe a charge is incorrect or unauthorized, we encourage you to contact us directly before initiating a chargeback with your payment provider:

  • Contact us at rok@kapion.eu with the details of the disputed charge
  • We will investigate and respond within ten (10) business days
  • If the charge was made in error or is unauthorized, we will issue a refund promptly

Resolving billing disputes directly with us is typically faster than the chargeback process and helps avoid potential disruptions to your account. If you initiate a chargeback, we reserve the right to suspend your account pending resolution of the dispute and to provide relevant transaction records to the payment processor.

13. Price Changes

We may change the price of our subscription plans from time to time. When we change prices:

  • We will notify you at least thirty (30) days before the new price takes effect via email to the address associated with your account
  • The notification will include the current price, the new price, the effective date, and instructions for canceling if you do not wish to continue at the new price
  • The new price will apply starting with the first billing cycle after the notice period
  • If you do not cancel before the new price takes effect, your continued use of the Service constitutes your acceptance of the new pricing

Promotional and early customer pricing is offered at our discretion and may be modified or discontinued at any time. Existing customers receiving promotional pricing will receive reasonable notice before any increase to their rate.

14. Governing Law

This Policy is governed by and construed in accordance with the laws of the Republic of Slovenia. Any dispute arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the competent courts in Murska Sobota, Slovenia.

If you are a consumer, mandatory consumer protection laws of your country of residence apply to the extent that they provide greater protection than Slovenian law. In accordance with the EU Rome I Regulation (Article 6), consumer protection provisions of your country of residence cannot be overridden by choice-of-law clauses.
