Acceptable Use Policy

1. Purpose and Policy Statement

This Acceptable Use Policy (“AUP”) defines the rules and standards of conduct governing your use of the RingRealtor platform and all related services (the “Service”) provided by KAPION d.o.o., a company registered in Slovenia under registration number 1683438000, with its registered office at Kocljeva ulica 16, 9000 Murska Sobota, Slovenia, VAT ID SI32880227 (“Company,” “we,” “us,” or “our”).

This AUP supplements and is incorporated into our Terms of Service. Capitalized terms not defined in this AUP have the meanings given in the Terms of Service. A violation of this AUP constitutes a material breach of the Terms of Service and may result in suspension or termination of your access to the Service.

The purpose of this AUP is to protect the security, integrity, and availability of the Service for all customers, to establish clear boundaries for acceptable conduct, and to ensure compliance with applicable laws and regulations.

2. Definitions

In addition to the definitions provided in our Terms of Service, the following terms apply to this AUP:

  • Content means any information, data, text, audio, recordings, transcriptions, configurations, scripts, messages, or other materials uploaded to, created within, transmitted through, or generated by the Service.
  • Prohibited Activity means any action, behavior, or use of the Service that violates this AUP, applicable law, or the rights of any third party.
  • End User means any individual who interacts with the Service through your account, including callers who are connected to the AI Agent on your behalf.

3. Scope and Applicability

This AUP applies to all customers, authorized users, employees, contractors, and any third parties who access or use the Service through your account. You are responsible for ensuring that all persons who access the Service under your account are aware of and comply with this AUP.

If an authorized user or third party violates this AUP through your account, you are responsible for that violation as if you had committed it yourself. You agree to take reasonable measures to prevent unauthorized use of the Service and to promptly notify us of any known or suspected violations.

4. Prohibited: Illegal Activities

You must not use the Service for any purpose that is illegal, fraudulent, or harmful under applicable law. Without limitation, you must not:

  • Engage in or facilitate fraud, money laundering, identity theft, phishing, or any financial crime
  • Use the Service to promote, facilitate, or engage in illegal gambling or lottery operations
  • Use the Service in connection with the sale, promotion, or distribution of controlled substances, illegal drugs, or unauthorized pharmaceuticals
  • Use the Service in connection with the sale or promotion of illegal weapons or regulated firearms in violation of applicable law
  • Make the Service accessible from, or use it in connection with, any country, territory, entity, or person subject to trade sanctions imposed by the European Union, the United States, or other applicable jurisdiction
  • Use the Service to engage in human trafficking, exploitation, or any activity that violates human rights

5. Prohibited: Security Violations

You must not compromise or attempt to compromise the security of the Service. Without limitation, you must not:

  • Attempt to gain unauthorized access to the Service, other customers’ accounts or data, or any systems or networks connected to the Service
  • Conduct penetration testing, vulnerability scanning, or security assessments of the Service without our prior written authorization
  • Bypass, disable, or circumvent any security measures, access controls, usage limits, or restrictions placed on the Service
  • Exploit any vulnerability in the Service, whether known or unknown, for any purpose
  • Share your account credentials with any unauthorized person or use another customer’s credentials
  • Transmit, upload, or distribute any virus, worm, trojan horse, ransomware, spyware, or other malicious code through the Service
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein

6. Prohibited: Network and Resource Abuse

RingRealtor operates on shared infrastructure. You must not use the Service in a manner that degrades performance or availability for other customers. Without limitation, you must not:

  • Launch or facilitate any denial-of-service (DoS) or distributed denial-of-service (DDoS) attack against the Service or any related infrastructure
  • Use the Service to send unsolicited bulk communications, spam, or engage in robocalling in violation of applicable anti-spam and telecommunications laws
  • Make excessive or abusive API calls that place disproportionate load on our infrastructure or degrade the Service for other customers
  • Use the Service for cryptocurrency mining, distributed computing projects, or other resource-intensive activities unrelated to the intended purpose of the Service
  • Manipulate or forge headers, identifiers, or other data to disguise the origin of any content transmitted through the Service

7. Prohibited: Content Restrictions

You must not use the Service to store, transmit, distribute, or make available any content that:

  • Constitutes, promotes, or facilitates child sexual abuse material (CSAM) or the sexual exploitation of minors in any form
  • Is discriminatory, hateful, or abusive toward any individual or group based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or any other protected characteristic
  • Is false, misleading, or intentionally deceptive and likely to cause harm to others or adversely affect the public interest
  • Constitutes non-consensual intimate imagery or deepfake pornographic content
  • Promotes or incites violence, terrorism, self-harm, or any activity that endangers the safety of any person
  • Contains malware, viruses, or any code designed to damage, disrupt, or gain unauthorized access to computer systems

8. Prohibited: AI Agent Misuse

The Service provides an AI-powered voice agent that interacts with callers on your behalf. You bear responsibility for how the AI Agent is configured and the information it conveys. Without limitation, you must not:

  • Configure the AI Agent to make false, misleading, or deceptive statements to callers, including misrepresenting property details, availability, pricing, or terms
  • Configure or use the AI Agent in violation of the Fair Housing Act, state fair housing laws, or any anti-discrimination statutes, including steering, discriminatory screening, or preferential treatment based on protected characteristics
  • Use the AI Agent to impersonate a specific real person without their explicit consent, or to represent that a caller is speaking with a human when they are speaking with an AI agent (unless applicable law or your configured disclosures inform the caller)
  • Attempt to manipulate, jailbreak, or inject adversarial prompts into the AI Agent to cause it to act outside its intended purpose or bypass its safety guardrails
  • Use the AI Agent to harass, threaten, intimidate, stalk, or discriminate against any person
  • Use the AI Agent to provide legal, financial, tax, or medical advice, or to make representations that could reasonably be relied upon as professional counsel
  • Use the AI Agent for unsolicited outbound telemarketing, robocalling, or any form of automated mass communication

9. Prohibited: Call Recording Misuse

All calls handled by the AI Agent are recorded and transcribed. You are solely responsible for ensuring that your use of call recording features complies with all applicable laws. Without limitation, you must not:

  • Record telephone conversations without providing adequate notice and obtaining any consent required by applicable federal, state, or local law, including laws requiring all-party consent
  • Use call recordings, transcriptions, or any information derived from calls for any purpose other than your legitimate business activities in connection with the Service
  • Share, distribute, sell, or make publicly available call recordings or transcriptions without the consent of all parties to the recorded conversation
  • Use call recordings to engage in blackmail, extortion, harassment, or any other unlawful activity
  • Disable, circumvent, or interfere with the call recording disclosure mechanisms provided by the Service

10. Prohibited: Privacy and Data Violations

You must respect the privacy rights of all individuals whose data is processed through the Service. Without limitation, you must not:

  • Collect, store, or process personal data through the Service in violation of applicable data protection laws, including the GDPR, CCPA, or any other privacy regulation applicable to your activities
  • Use the Service to scrape, harvest, or systematically collect personal information without authorization or lawful basis
  • Use the Service to conduct surveillance or monitor individuals without their knowledge and consent where such consent is required by law
  • Sell, share, or disclose personal data of callers or contacts obtained through the Service without the informed consent of the individuals concerned
  • Publish or disclose private information about any person (doxing), including addresses, phone numbers, financial information, or other personal details, without their consent
  • Use the Service to compile databases of personal information for marketing, data brokering, or any purpose unrelated to your legitimate use of the Service

11. Prohibited: Intellectual Property Violations

You must respect the intellectual property rights of KAPION d.o.o. and third parties. Without limitation, you must not:

  • Use the Service to infringe, misappropriate, or violate any copyright, trademark, patent, trade secret, or other intellectual property right of any third party
  • Remove, alter, or obscure any copyright notices, trademark notices, or other proprietary rights notices contained within the Service
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying technology of the Service, except to the extent expressly permitted by applicable law (including the EU Software Directive for interoperability purposes)
  • Copy, reproduce, or create derivative works based on the Service or any part thereof
  • Use the RingRealtor name, logo, or trademarks without our prior written permission

12. Prohibited: Competitive Misuse

You must not use the Service for competitive intelligence or to undermine our business. Without limitation, you must not:

  • Access or use the Service for the purpose of monitoring its availability, performance, or functionality for benchmarking or competitive analysis
  • Use the Service, its features, designs, or underlying concepts to develop, improve, or market a product or service that competes with RingRealtor
  • Circumvent or attempt to circumvent any pricing structures, subscription tiers, feature limitations, or access restrictions of the Service
  • Resell, redistribute, or provide access to the Service to third parties without our prior written consent

13. Your Security Responsibilities

You are responsible for maintaining the security of your account and your use of the Service. You agree to:

  • Use a strong, unique password for your account and change it promptly if you suspect it has been compromised
  • Enable multi-factor authentication when available and use it for all account access
  • Keep all account credentials confidential and not share them with unauthorized persons
  • Promptly report any security incidents, unauthorized access, or suspected vulnerabilities to us at rok@kapion.eu
  • Ensure that any third-party integrations or applications connected to your account are kept up to date and do not introduce security vulnerabilities
  • Comply with all applicable laws and regulations regarding data security and the protection of personal information processed through the Service

14. Monitoring and Investigation

We reserve the right, but do not assume the obligation, to monitor your use of the Service for compliance with this AUP. We may investigate any suspected violation of this AUP or misuse of the Service, including by:

  • Reviewing system logs, usage patterns, and activity records associated with your account
  • Examining content stored on or transmitted through the Service to the extent necessary to investigate a reported or suspected violation
  • Cooperating with law enforcement authorities, regulatory bodies, or third parties in the investigation of suspected illegal activity

We may report any activity that we reasonably suspect violates applicable law to the appropriate law enforcement officials, regulators, or other authorities. Such reporting may include disclosing relevant account information as required by law or as we deem reasonably necessary.

15. Enforcement and Consequences

Violations of this AUP may result in one or more of the following actions, applied at our commercially reasonable discretion based on the nature and severity of the violation:

  • Warning: written notification of the specific violation and a request to cease the prohibited activity immediately
  • Cure period: for non-material violations, we may provide a period of fifteen (15) days to remedy the violation before further action is taken. Material AUP violations are subject to the termination and cure provisions of our Terms of Service
  • Suspension: temporary suspension of your access to the Service, in whole or in part, while the violation is investigated and resolved
  • Termination: permanent termination of your account and access to the Service, in accordance with the termination provisions of our Terms of Service
  • Legal action:pursuit of legal remedies, including claims for damages, injunctive relief, and recovery of costs and attorneys’ fees

We reserve the right to suspend your access immediately and without prior notice if a violation poses an imminent threat to the security or integrity of the Service, impacts other customers, involves illegal activity, or otherwise requires urgent action to protect our interests or the interests of third parties.

Upon termination for an AUP violation, we may, at our sole discretion, make your Customer Data available for export for a limited period. For violations involving illegal activity, we reserve the right to retain data as required by law or for the purpose of cooperating with law enforcement, and to withhold data that constitutes or contains evidence of illegal activity. You remain liable for all fees accrued prior to termination.

16. Reporting Violations

If you become aware of any violation of this AUP or any activity that may compromise the security, stability, or integrity of the Service, you must report it promptly by contacting us at rok@kapion.eu.

When reporting a violation, please provide as much detail as possible, including the nature of the violation, the accounts or users involved, and any supporting evidence. We will review reports and may take appropriate action at our discretion.

17. Modifications to This Policy

We reserve the right to modify this AUP at any time to address emerging threats, new regulatory requirements, or changes in the Service. For material changes, we will provide at least thirty (30) days’ prior notice via email to the address associated with your account or through a prominent notice on the Service, except where an immediate update is necessary to address a security threat, comply with a legal requirement, or prevent ongoing harm to the Service or its users, in which case the change may take effect immediately upon notice.

Your continued use of the Service after the effective date of any modification constitutes your acceptance of the updated AUP. If you do not agree to the modified terms, your sole remedy is to cancel your subscription and discontinue use of the Service before the effective date of the changes.

18. Severability

If any provision of this AUP is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect any other provision of this AUP. The remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

19. Governing Law and Jurisdiction

This AUP is governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of laws provisions. Any dispute arising out of or relating to this AUP shall be subject to the exclusive jurisdiction of the competent courts in Murska Sobota, Slovenia.

If you are a consumer residing in the European Union, you may also be entitled to bring proceedings in the courts of your country of residence in accordance with applicable EU consumer protection regulations. You may also use the European Commission’s Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.
